I have a 2012 Chevy Malibu and it's leaking from the top tap why

When I drive it kind of wants to heat up and then it throws the transmission oil through the top cap

Have you checked the seal of the cap? Maybe it has gone bad. All transmissions heat up the center console to some degree. You may just be overthinking the transmission fluid leak.
